Welcome to WorkPodium, a platform operated by TrackMyGuys LLC, registered in Connecticut, United States of America (“WorkPodium”, “we”, “our”, or “us”). These Terms of Use (“Terms”) govern your access to and use of the WorkPodium platform, website, mobile applications, and related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Overview
WorkPodium provides a workforce and business management solution, offering tools for employee management, time tracking, productivity reports, timesheets, payroll management, and client and service management. These Terms apply to all clients and authorized users who access the platform on behalf of a business or organization.
2. Eligibility
You must be at least 18 years old and have the legal authority to enter into contracts on behalf of your organization to use our Services. By creating an account, you represent that all information provided is accurate, complete, and current.
3. Account Registration and Security
To use WorkPodium, you must create an account and provide required business and user details. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. If you suspect unauthorized access, you must notify us immediately at support@workpodium.com.
4. Subscriptions and Payments
WorkPodium offers monthly and annual subscription plans, each with a 30-day free trial period. At the end of the trial, the subscription will automatically renew unless canceled before the trial ends. All fees are non-refundable once a billing cycle begins. Prices and subscription terms are subject to change, and any modifications will be communicated in advance.
5. Use of the Services
You agree to use the Services only for lawful business purposes. You must not:
Copy, modify, or distribute any part of the platform without authorization.
Use the Services to collect or process unlawful or unauthorized data.
Attempt to gain unauthorized access to the system or interfere with its functionality.
6. User Responsibilities
Clients are responsible for:
Managing their teams and user access within the platform.
Ensuring compliance with applicable labor laws, data protection laws, and business regulations.
The accuracy of information submitted through the system, including payroll and attendance records.
WorkPodium is not responsible for errors or disputes resulting from inaccurate data input by users.
7. Data Privacy and Security
We respect your privacy and handle your information according to our Privacy Policy. By using our Services, you consent to the collection and processing of data necessary for providing and improving our platform. We implement reasonable technical and organizational measures to protect data but cannot guarantee absolute security.
8. Intellectual Property
All content, software, trademarks, and materials within WorkPodium are the property of TrackMyGuys LLC or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Services solely for your internal business operations. 9. Termination
We may suspend or terminate access to the Services at any time if you violate these Terms, fail to pay fees, or misuse the platform. Upon termination, all rights granted under these Terms will immediately cease.
10. Disclaimer and Limitation of Liability
The Services are provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, TrackMyGuys LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Services, including loss of data, revenue, or profits.
11. Changes to the Terms
We may update these Terms from time to time. The updated version will be posted on our website with a revised “Last Updated” date. Your continued use of the Services after changes are posted constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Connecticut.
